A. Definitions

We use these basic terms throughout the agreement, and they have specific meanings.

B. Account Terms

A human must create your Account; you must be 13 or over; you must provide a valid email address. You alone are responsible for your Account.

1. Account Controls

Subject to these Terms, you retain ultimate administrative control over your Personal Account and the Content within it.

2. Required Information

You must provide a valid email address to complete signup. Other information (such as your real name) is optional, unless you are accepting these terms on behalf of a legal entity.

3. Account Requirements

• You must be a human. Accounts registered by bots or automated methods are not permitted.
• One person or legal entity may maintain no more than one Account.
• A single login may not be shared by multiple people.
• You must be at least 13 years of age to create an Account.
• Your use must not violate any applicable laws, including copyright, trademark, export control, or sanctions laws.

4. Account Security

You are responsible for keeping your Account secure. This includes:

• All content posted and activity that occurs under your Account.
• Maintaining the security of your password. OpenDetail will not be liable for any loss resulting from your failure to comply.
• Promptly notifying us at contact@opendetail.org if you become aware of any unauthorised use of your Account.

C. Acceptable Use

Be excellent to each other.

Your use of the Website and Service must not violate any applicable laws. You are responsible for ensuring your use complies with all laws and regulations. You agree not to violate these terms of use under any circumstances.

The following activities are expressly prohibited and may result in immediate suspension or permanent termination of your Account, without prior notice:

• Unauthorised access to other users' data or accounts.
• Attempts to circumvent, disable, or interfere with access controls or security features.
• Injection attacks, scraping, or automated exploitation of the Service.
• Uploading malicious content, malware, or files designed to compromise the Service or its users.
• Any activity intended to disrupt, degrade, or overload the Service.

OpenDetail employs automated security monitoring to detect violations. Rambøll Group Denmark and Henning Larsen reserve the right to report unlawful activity to the relevant law enforcement and data protection authorities, and to pursue legal action where necessary to protect the Service, the personal data of our users, and our legitimate interests.

D. User-Generated Content

You own your content, but you grant us and other users certain rights so we can display and share it.

1. Responsibility

You are solely responsible for User-Generated Content that you post, upload, or make available via the Service. We are not responsible for any public display or misuse of your content.

2. Content Removal

We may refuse or remove any content that, in our sole discretion, violates any laws or these terms.

3. Ownership and License Grants

You retain ownership of your Content. You agree to only submit Content you have the right to post. You grant us and other users the permissions listed below. You will not receive payment for these rights. The licences end when you remove your Content.

4. Licence to Us

You grant us the right to store, archive, parse, and display your Content as necessary to provide the Service. This does not grant us the right to sell your Content.

5. Licence to Other Users

By making your details public, you grant each User a nonexclusive, worldwide licence to use, display, and reproduce your Content on OpenDetail.

6. Contributions

By adding details, you confirm you have the right to licence that content. This is standard practice in the open-source community.

7. Moral Rights

You retain all moral rights to your Content. However, you waive these rights against us to enable us to exercise the rights granted in Section D.4.

E. Copyright Infringement

If you believe content on our website violates your copyright, contact us at contact@opendetail.org. Before sending a takedown request, consider legal uses such as fair use. False or frivolous notices may have legal consequences. Repeat infringers will have their Accounts terminated.

F. Intellectual Property

We own the service and its design. You may only use our content as we have permitted.

OpenDetail and our licensors retain all intellectual property rights related to the Website and Service. The look and feel of the Website is copyright © OpenDetail. You may not duplicate, copy, or reuse any portion of the design, code, or visual elements without express written permission.

G. Cancellation and Termination

You may close your Account at any time. We will treat your information responsibly.

1. Account Cancellation

You can cancel your Account at any time through the "Delete my account" option in your Account Settings, or by emailing contact@opendetail.org with the subject: Account cancellation.

2. Upon Cancellation

We will delete your full profile and content within 90 days of cancellation. Some information may remain in encrypted backups. We retain information as necessary to comply with legal obligations, resolve disputes, and enforce agreements. This data cannot be recovered once deleted.

3. OpenDetail May Terminate

We may suspend or terminate your access at any time, with or without cause, with or without notice. We reserve the right to refuse service to anyone for any reason.

4. Survival

Provisions that should survive termination will survive — including ownership, warranty disclaimers, indemnity, and limitations of liability.

H. Communications

We use email to stay in touch with our users.

You consent to receive communications electronically via the email address you provided. Electronic communications satisfy any legal requirement for written communication. Legal notices to OpenDetail must be sent to contact@opendetail.org. We only offer support via email.

I. Disclaimer of Warranties

We provide the service as is. We make no promises or guarantees.

OpenDetail provides the Website and Service "as is" and "as available," without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement. You assume full responsibility and risk for downloading and using content from the Service.

J. Limitation of Liability

We are not liable for damages or losses arising from your use of the service.

We will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages arising from: the use or display of your Content; your use or inability to use the Service; any modification or discontinuance of the Service; unauthorised access to your data; or any other matter relating to the Service. This applies whether or not we have been informed of the possibility of such damages.

K. Release and Indemnification

You are responsible for your use. If you harm someone or get into a dispute, we are not involved.

If you have a dispute with one or more Users, you release OpenDetail from all claims, demands, and damages arising from such disputes. You agree to indemnify, defend, and hold us harmless from all claims, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of this Agreement.

L. Changes to These Terms

We may update these terms. We will give you 30 days notice of material changes.

We may amend these Terms at any time. We will notify users of material changes at least 30 days before they take effect, via a notice on the Website or email to your registered address. Continued use after 30 days constitutes agreement. We may also modify or discontinue the Website at any time.
